Vispārīgie noteikumi

Šie lietošanas noteikumi regulē X DIGITAL ASSETS SIA (Reģ. Nr. 40203611907, turpmāk — "XDA") vietnes xda.lv (turpmāk — "Vietne") izmantošanu.

Piekļūstot Vietnei vai izmantojot tās saturu, Jūs apliecināt, ka esat iepazinies ar šiem noteikumiem un piekrītat tiem. Ja Jūs nepiekrītat noteikumiem, lūdzam neizmantot Vietni.

XDA patur tiesības jebkurā laikā mainīt šos noteikumus. Izmaiņas stājas spēkā brīdī, kad tās publicētas Vietnē.

Vietnes saturs ir informatīvs. Konkrētu pakalpojumu apjoms, cena un nosacījumi tiek noteikti atsevišķā rakstiskā līgumā.

Intelektuālais īpašums

Vietnes saturs — teksti, grafika, logotipi, ikonas, attēli, audio un video materiāli, programmatūras kods un dizains — ir X DIGITAL ASSETS SIA vai tā licences devēju intelektuālais īpašums un ir aizsargāts ar autortiesībām un preču zīmju tiesībām.

• Vietnes materiālus drīkst apskatīt personiskai izmantošanai.
• Komerciāla reproducēšana, izplatīšana vai publicēšana bez rakstiskas atļaujas ir aizliegta.
• XDA™ nosaukums un logotips ir reģistrēta preču zīme. Tā izmantošana bez atļaujas ir aizliegta.

Aizliegtā izmantošana

Izmantojot Vietni, Jums ir aizliegts:

• Veikt darbības, kas pārkāpj Latvijas Republikas vai ES tiesību aktus.
• Mēģināt nesankcionēti piekļūt Vietnes infrastruktūrai vai datubāzēm.
• Veikt automatizētu datu iegūšanu (web scraping, crawling) bez iepriekšējas rakstiskas atļaujas.
• Izplatīt ļaundabīgu programmatūru vai jebkādus kaitīgus kodus.
• Veikt darbības, kas apgrūtina vai traucē Vietnes normālu darbību (DoS uzbrukumi u.c.).
• Viltot savu identitāti vai pārstāvēt citu personu vai organizāciju.
• Publicēt maldinošu, komerciāli kaitīgu vai nelikumīgu saturu.

Atbildības ierobežojums

XDA cenšas nodrošināt vietnes pieejamību un satura precizitāti, taču:

• Vietne tiek nodrošināta "kāda ir" — bez garantijām par nepārtrauktu darbību vai kļūdu neesamību.
• XDA neatbild par zaudējumiem, kas radušies tehnisko kļūmju, datu zuduma vai nesankcionētas piekļuves dēļ, ja XDA veikusi saprātīgus drošības pasākumus.
• Informatīvais saturs nav juridisks, finansiāls vai medicīnisks padoms. Konkrētiem jautājumiem vērsieties pie attiecīgā nozares speciālista.

Vietnes pieejamība un uzturēšana

XDA var jebkurā laikā:

• Mainīt vai papildināt vietnes saturu bez iepriekšēja brīdinājuma.
• Pārtraukt vietnes vai atsevišķu tās daļu darbību plānoto vai neplānoto apkopju laikā.
• Ierobežot piekļuvi Vietnei no noteiktiem reģioniem vai IP adresēm drošības apsvērumu dēļ.

Saites uz trešo pušu vietnēm

Vietne var saturēt saites uz trešo pušu vietnēm. XDA neuzņemas atbildību par šo vietņu saturu, privātuma praksi vai pakalpojumiem. Piekļūstot trešo pušu vietnēm, Jūs pakļaujaties to lietošanas noteikumiem.

Piemērojamie tiesību akti un strīdu risināšana

Šie noteikumi ir interpretējami un piemērojami saskaņā ar Latvijas Republikas tiesību aktiem.

Strīdi tiek risināti pārrunu ceļā. Ja vienošanās nav iespējama, strīds tiek nodots Rīgas pilsētas tiesai atbilstoši Latvijas Civilprocesa likumam.

Patērētāji var arī vērsties Patērētāju tiesību aizsardzības centrā vai izmantot ES tiešsaistes strīdu izšķiršanas platformu.
